A Homeownership Counseling List: What Is It?

The Housing Counseling Program of the U.S. Department of Housing and Urban Development (HUD) offers various types of Homeownership Counseling. Lenders are not required to provide a list of counseling organizations for mortgage loans secured by timeshares, as per 11 U.S.C. 101 (53D). However, they can use CFPB-developed housing counseling lists, which were created in 2013.

The CFPB has issued a final rule to assist lenders in complying with RESPA and TILA homeownership counseling requirements. Under RESPA, a lender must provide a list of housing counseling agencies that are closest to the borrower. This list ensures fairness and equity among counseling agencies, offering loan applicants a thorough and comprehensive experience.

Homeownership Counseling is defined as housing counseling related to homeownership and residential mortgage loans when provided in connection with homestead loans on property of 25 acres or more. The lender must provide the borrower with a clear and conspicuous written list of counseling organizations that provide relevant counseling. The Bureau of Consumer Financial Protection (Bureau) is reissuing a prior interpretive rule regarding the provision of lists of HUD-approved housing counseling.

The counseling agencies on this list are approved by the U.S. Department of Housing and Urban Development (HUD), and they can offer advice on buying a home, renting, defaults, forbearances, foreclosures, and credit issues. The rule requires disclosures to contain new specific information and wording about the loan, including information about the counseling services offered by the creditor and a list of HUD-approved nonprofit home-ownership counseling organizations or the toll-free number.
