Short-term disability insurance can be used to cover parental leave and childbirth recovery, but it depends on the policies of your employer and the state you live in. It is important to talk to your employer before a pregnancy to ensure that they offer paid leave options. Both short-term disability and the FMLA provide protection for employees who need to take a leave of absence from work, but each has its own requirements.
Most companies require you to use up your sick, vacation, and holiday time before using your STD benefits for maternity leave. While you can use your STD benefits for maternity leave, it can also be used in any other instance. To get short-term disability approved while pregnant, you must demonstrate that you are unable to work due to your pregnancy, childbirth, and recovery, and can demonstrate that you can.
Short-term disability plans can cover a portion of your income during maternity leave, but you should carefully review your policy. Maternity would qualify for benefits under short-term disability plans if you can demonstrate that you are unable to work due to your pregnancy, childbirth, and recovery, and can demonstrate that you can. Disability is generally considered a medical condition which prevents work, and new mothers (who aren’t self-employed) can use short-term disability for maternity leave, while expectant fathers don’t have that option.
After giving birth, a worker may be eligible for both short-term disability benefits and Paid Family Leave, but the two benefits cannot be taken at the same time.

What is STD in terms of leave?
Short-Term Disability (STD) is a type of disability insurance that provides income protection for employees who are unable to work due to an injury or illness. It typically begins within one to 15 days of the event causing the disability and lasts for 10 to 26 weeks. FMLA, on the other hand, is a federal law that provides eligible employees with unpaid leave, job reinstatement rights, and continued health insurance benefits for up to 12 weeks when an employee experiences certain family or medical events.
Employers are not required to provide STD benefits on a federal level, but six localities have laws that require disability coverage. Eligibility for STD benefits is determined on the federal level and is described in the Department of Labor’s Employer’s Guide to FMLA.

If an employer offers leave for other medical conditions, illnesses, and disabilities, it must offer leave for pregnancy-related issues. The FMLA works to protect pregnant employees from discrimination under the federal Pregnancy Discrimination Act (PDA).

What does STD mean on my paycheck?
Short-term disability (STD) is a policy that allows employees to continue their base salary and certain benefits when they cannot perform their work duties due to a serious health condition. This condition can be caused by illness, injury, impairment, or physical or mental conditions involving inpatient care, treatment by a physician, or pregnancy. Or should I ask the doctor to reissue it by starting from 3/11 instead?
Thank you so much for this. I have a question I need clarification for. So my employer won’t pay for any pre-partum time (the 4 weeks pre due date) that SDI will partially cover. I plan on checking “Yes” to the following question and indicate “Parental Leave” as other type of pay. Is that the right understanding? Thanks!!! *Has or will your employer continue to pay you during your disability leave? Yes No If “Yes,” indicate type(s) of pay: Sick Vacation Paid Time Off Annual Leave Other Type of Pay: Parental Leave

Quick Question – Should the pregnancy disability with the state be filed only after 9 calendar days after the last day worked? For example, if the last day worked was Friday, April 7th and the disability began on Monday, April 10th, then can the preganacy disability be filed with the CA State only on April 20th? Appreciate your inputs and feedback!
My daughter is a teacher and is not due till August 1st, 23 She is off for summer and is being paid for summer because she set it up that way. The first day of the new school year is August 1, 2023. She is trying to apply for SDI to begin on that date but it will not allow her to file for future dates. So how does she get the paperwork filed so its ready to go then? She doesn’t need the disability till August 1, 2023 (baby’s due date) but wants the paperwork filed prior. Is this possible to do this? Can she apply even tho she is still receiving her salary through summer and stopped working June 7th, 2023 because it was the end of the school year. Should she put June 7th as last day worked but not want to receive benefits till August 1st? Thank you
Thank you for this article! About a year late but I have a question regarding the 4 weeks prior to my delivery date. When filing for the 4 weeks prior. Will I be just filling for the 4 weeks until my due date or would it be 4 weeks prior plus the 6-8 weeks for the recovery time as well. My company is big and I will be getting paid for recovery time which the 6/8 weeks after due date.
So I have high risk pregnancy and was given modified or disability ( way early) (2nd trimester) depends on employers accommodation, so my employer said itl be better to be off work and safely go thru my pregnancy. My employer mentioned applying for disability. An I just submitted. The certificate started 5/15/23. And I was also got off work since then. Now EDD is asking medical certificate form? Does this has to come from physician? Tho I know my employer has a copy too.
Thank you for your helpful article. I do have a question, I was working as a teacher for the previous school year through an agency company, my last day being June 02, and I was unable to return. I start a new part time job on August 25 and will go on maternity leave September 22 for my 4 weeks out. (so only a month at this new job) When I apply for State disability, do I put the employer as the part-time job I will currently be at, or the previous teaching one through the agency since that was full-time and who I paid into SDI with. Or do I put both? Thank you!
Hi, the article was very informative! I was recently laid off and have been claiming unemployment insurance and still actively searching for employment. I am pregnant and my due date is 12/19/23. Should I transition from UI to SDI 4 weeks prior to my due date by indicating the claim start date for SDI as 11/21/23? Would all the employer details shown in the article still be applicable in my case given the layoff and unemployment insurance? Also, if I deliver the baby before the expected due date, will I still be eligible to receive 4 weeks + 6 weeks (assuming it is normal delivery) of benefits for pregnancy from EDD or will the period be shortened accordingly? Thanks in advance!!
Hi, thank you so much for your article. I hope you can answer me this question. I applied just now, I already had an existing EDD account. Just had to apply for SDI but I didn’t give me all the Options for employer and all that. Is that normal? I just get a note saying the send something on the mail. I’m a little confused.

Hi Caela! I started working for my current company in Oct 2022 and my due date is in July 2023. Am I still qualified for the 4 weeks of DI since I’ve been working for less than 1 year at my current company? I am also trying to file a DI claim but I don’t know how I should answer questions like when is my last work day & when did your disability begin since I am still working and am filing for a future due date. Can you please advise? Thank you.
Hello, my wife recently got a physicians statement to extend her Disability period from 3-11-23 to now 6-3-23. My question is: Does she have to submit anything else or just wait for the next payment to come in? On her profile it now says: “To continue to receive payments, submit the Continued Claim Certification”…. I can’t find this from anywhere. Will EDD send this form in a message soon? Thanks
Hello everyone, any idea how to increase income during pregnancy? My job cut off my hours to 1/3 of the time after I told them I’m 5 months pregnant. And now I don’t have enough income even to cover my bills. So I’m wondering if anyone knows anyone programs than may help me for these months here in California. 🙏
I’m extremely confuse, and there’s still some stuff you didn’t go over. What if you deliver before you’re expected date? Seriously most women don’t even deliver on their delivery date. Do you need to update EDD that hey your baby was born so they can give you more accurate dates of how long your leave is? I don’t like that that wasn’t gone over You just kind of assumed people knew that answer:( Along with that not all women start their leave at exactly 4 weeks before they’re delivery date. Most like myself are starting their leave at 38 weeks.
Usa is the worst benefits for pregnant n mom giving birth… only 6w paid at work n u must sign disability to pay for u 6w. Total is 12w while usa support europe army so they have more money to treat their people benefits better than USA… all women need fighting to get more benefits for maternity (light duty auto at work, 6months PLF with 80-100% paid not 75%) If not stop giving birth. Women should not be strong while all women need care before n after giving birth.
