Oml Maternity Leave: What Is It?

Statutory Maternity Pay (SMP) and Statutory Maternity Leave (SML) are often confused, but the most significant difference is that SML is compulsory, while SM refers to the first 26 weeks of maternity leave. Ordinary maternity leave (OML) is the first 26 weeks of maternity leave, and employees can return to their jobs as before after OML.

In the U.S., the Family and Medical Leave Act dictates the rules for taking and returning to work during pregnancy, birth, and postpartum stages. The first 26 weeks of OML are ordinary maternity leave (OML), and the second 26 weeks are additional maternity leave (AML). The terms date back to when maternity leave was less generous but are now more generous.

Employees have the right to 52 weeks of maternity leave with the right to return to work. Eligible employees can take up to 52 weeks of OML, with the first 26 weeks known as “Ordinary Maternity Leave”, and the last 26 weeks as “Additional Maternity Leave”. All employees, regardless of their length of service or number of hours worked each week, are entitled to 26 weeks additional maternity leave (AML).

To apply for maternity leave, a woman must tell her employer at least 15 weeks before the week in which the leave is due. All pregnant employees have a right to 26 weeks of ordinary maternity leave (OML) regardless of their length of service.
