Can You Avoid Jury Duty If You Don’T Have Childcare?

The text discusses the legal exemptions and excuses that can be used to get out of jury duty, including those who are the primary caregiver to a child under the age of 10. In New Mexico, there are several excuses that can be used to legally get out of reporting for jury selection or jury duty, or receive a deferral. California has a list of specific excuses that can be used to be exempt from reporting for jury duty, including military, elected official, age, police, medical worker, and other factors. Disqualifying factors for jury duty often include age, residency, citizenship, and criminal history.

In New York, there are specific excuses that can be used to be exempt from reporting for jury duty, including military, elected official, student, breastfeeding, age, police, and more. While getting out of jury duty altogether is highly unlikely for most people, it still means that older adults can still perform their civic obligation. Most states now allow older adults to opt out of jury duty, with the age varying from state to state.

The answer to whether a parent can get out of jury duty to take care of children depends on their local jurisdiction, and some are more lenient than others. Being a stay-at-home parent is a legitimate excuse, and you can select it on the online form to request an exemption. If you can get a sitter for the initial appearance, you may get excused.

A simple written explanation to the judge stating that you are the full-time caregiver to non-school-aged children would excuse you from jury duty. You could potentially use nursing as a substitute for jury duty, and currently being a full-time student Jury duty within the past year may also be a valid reason to ask to be excused.

Should I be nervous about jury duty?

Jury duty is a civic responsibility that requires U. S. citizens to serve as jurors in court proceedings. The National Center for State Courts, an independent research organization, estimates that only about 15 out of the population are summoned for jury duty, with only 5 out of 15 actually being part of a jury. The data was collected from 1546 counties, representing 70 percent of the U. S. population at the time. Jury duty works by summoning citizens to participate in a selection process, which includes sworn in members of a jury.

The jury then passes a judgment, renders a verdict, and chooses a penalty for a legal case. Jury duty is a crucial obligation for the defendant’s Sixth Amendment right, ensuring a speedy trial and an impartial jury. If not selected, jurors receive compensation for their time off and pay. Jury duty is a crucial aspect of the U. S. justice system and should not cause nervousness.

  • I don’t think anyone should be forced to do jury duty. I’ve received four jury summons and I get a sick feeling every time I see a notice with my name on it. I honestly don’t feel comfortable judging someone else. I have zero experience in law and can’t imagine making a decision that effects someone else’s life. Why don’t they make this an actual paid position?

  • I feel in my own personal opinion, jury duty shouldn’t be forced, it should be optional for most because you don’t want someone who doesn’t want to be there on a jury cause they will do anything to muck things up in anyway they see fit, you want a jury that wants to be there and to do their part, or someone like me who is severely antisocial and very against alot of things the justice system and government does. I have severe anxiety and social anxiety, I know without a doubt I wouldn’t be a good juror but I still have to show up and have the possibility to be put on a jury which in my own personal opinion a very poor choice of the government and the justice system.

  • And it’s no longer simply “showing up for jury duty.” Today you are summoned (a word once reserved for criminals) for “serving” (another negative-connotative word) for an entire week. Who’s the criminal here? YOU if you don’t comply and no excuses count. But seriously, it’s the very lawmakers who need serious reforming.

  • No mention of Jury Nullification? This is the most important thing to educate yourself about, since the courts will not. A jury is the last defense citizens have against unjust laws. It’s the only reason juries even exist. Why does the judge need random people to apply the law? The founding fathers knew what they were doing. BTW, why so many cuts? There are multiple cuts per sentence!

  • This should be illegal to make people go to jury duty! Unless they make it a full time job. THEN I WILL GO! Every time i went, they said it was cancelled! was paid and went home ! THIS IS BS ~ It reined my plains and day. The pay is not even worth going for 🤬 Going to get me a Attorney and see if i got a case or not. tired of the BS > SCREW THEM AND THE CENSUS BUREAU BOTH

  • I couldn’t get on the website given on the card, so had to do the pre-interview over the phone. The woman I talked to was so MEAN (“I’ve heard it all before” attitude). I told her I was on disability for mental illness but she said I still had to go. This is tomorrow early, and there’s a big snowstorm even as I type this. I live at the end of a long, private dirt road that my husband has to plow us out of. Again, I called the courthouse and told them of this potential problem, she got REALLY annoyed and said I had to come.

  • I’ve only been called once… in my home state, literally weeks after I moved across the country. Which was an easy out. Never once in my current state of 13+ years. (Knock on wood) 😁 No felonies that I know of. My husband, geesh there for a while he was getting called every year and he never skipped or postponed it. We moved counties though. Nothing in the last 5 years.

  • I can’t afford to do jury duty. I’m months behind on my electric bill, and I need as many working days as possible to catch up. And of course I’m not the only one who has this problem. I suspect that people would be more inclined to accept jury duty if there were a living wage. Or better yet, if there were basic income.

  • I got this notice a couple weeks ago. What if I’m halfway around the world in Australia on vacation, I’m forced to say screw my vacation and money i spent to get there? Or worse, what if I just arrived in Australia and no one picks up my mail and when I get back I find I’ve broken the law? If they want to force us, then at least have the courtesy to send out these notices 6 months in advance. Demonstrate a little coot, brains, and respect government and the archon who run it which I know you can’t. They lack everything decent.

  • As a lawyer, I’ll tell you how to be excused every time: Just tell the court “I believe in jury nullification. I won’t promise to follow the court’s instructions because I believe that the jury is entitled to determine both the law and facts.” This is actually the law, established in the Bushel case 300 years ago. But if you let the court know you are aware of the right of jury nullification, you’ll be excused every time. If you follow this advice you don’t have to tell the court a single lie to be excused.👍

  • In Houston, I sat on a civil jury in 2004. After the trial was over, the Judge spoke to us as a group to thanks us for showing up. He said that when a jury summons is mailed out and that person doesn’t show up, there is nothing the court can do because they would have to prove that the summons actually was delivered to your residence. The Judge also said that the solution would be to send them by certified mail, but that is too expensive.

  • I don’t think we need the judge in the court, since we have jurors in the courtroom to make the decision that it is guilty or not guilty of the trial. It is a big waste of paying the salary to the judge. They are useless for making the decison to the defendant and plaintiff. The jurors are the ones who make the decision or judging guilty or not guilty, not the judge. Then why we need to pay high salary for the judge to be in the courtroom. They are useless and wasting our tax dollars.

  • Court houses are never in a nice area. Homeless, etc. lurking around. People on probation walking by, glaring at you. You have to park and walk past them to get to the courthouse. Then you have to stand in line like cattle with a bunch of other people who do not want to be there. Then get called to check in and now have to sit at a germy table in a room with hundreds of people. Coughing, hacking, etc, It’s disgusting. Ironically they are not concerned about the health or safety of the jurors. Then they want you to answer personal questions in front of strangers. Once I was called for a murder trial and the defendant was sitting right there turning around so he could see the jurors. Not scary at all. (smh) Not sure why they can’t do this with Zoom calls?????

  • I have friends who have never been called. I get called EVERY SINGLE YEAR! It’s insanity. It’s not just me, my entire household gets called every year. I really think it is because Florida has so many people over 70 (don’t have to serve if you are over 70), so many non-citizens and so many people who have a criminal record. They don’t have a number for you to call so you have to show up for this. This should be volunteer basis. Some people like the idea and others will totally be effected by having to go for jury duty and do not want to go.

  • I only got called once. My employer actually paid the employees for days they had to serve pluse we got to keep the jury pay so I actually hoped I’d get selected. I went through selection for a case later in the day but was dismissed after a few questions and told I could head home and that was that (they had enough of a jury pool in that county that it was a one day thing). Look, it’s one of those things people seem to hate. At the same time, if they were ever in a position to need to go to trial for something, they’d want a jury of people to be avaiable.

  • I was summoned three times to come in. Threats of fines and prison time were made. I just never responded or went in. Eventually they said my service has been completed. My suggestion is never respond and most of the time they move on to other. I live in a big city so that probably helped them move on to more compliant people. Only time you should take serious anything from the government is through the IRS. Anything else just toss in the trash where the government belongs.

  • In Georgia they changed the rules so if your not a registered voter you can still be picked. Statewide master list is comprised of Department of Driver Services records of driver’s licences and personal identification card holders, valid or expired, but excluding those who have had licenses revoked due to felony. Registered voters provided by Secretary of State.

  • Bro thank you! for this info I was able to defer my service online, I live in FL. they dont make it easy to find either that’s for sure, I had to look around for awhile ! I did it all online from a site listed on my paper. It gave a list of reasons I clicked “other” hit enter and it said it had to be approved. I checked 20 min later and it got approved! It allowed to defer 6 months first time and I think I can do it again if need be for another 6 months.

  • Where’s the proof you received the notice? Nothing ever gets lost in the US mail? Counts dismiss unlawful detainers against landlords every day because the landlord cannot provide the court satisfactory proof of service to the tenant. Are the courts and government exempt from their own rules? Unlike everyone else, they can just assume you received it in the mail, end of story? The government simply can’t be bothered with having to follow the same rules they force everyone else to follow?

  • I’m 19 and live in Florida I voted for the first time in 2020 i got called to serve Jury Duty for the first time this October 10th, 2021. I filled out the questionnaire form with my phone number and my parents mailed it back but that’s just about it. Don’t think I’ll show up though. It’s stupid that they select random citizens when there is people that actually want to volunteer or make this there actual job. I live in a small town of about 10,700+ people I wonder if they will come after me. What I also find stupid is that in most states you can fill out and online form to remove yourself from the voting system but I can’t seem to find one for Florida all I see is N/A on the website and the reason I mentioned this is because this is how I found out on how they get you in there system is when you vote. Update – The Jury Duty I was supposed to serve got canceled. I ended up moving out of the small town and moved to a bigger city.

  • Jurors will be paid minimum wage or they don’t show up…period! When an entity requests you to perform a job, you are guranteed a minimum wage. Because you are serving the state, you are entitled to minimum wage based off of state minimum wage. Getting paid a days wage that is less than an hours pay is indentured servitude. The pay does not cover food, transportation or real work pay salary loss. The current pay that a juror gets is equiptable to a prison inmate. Do not let the Government fool you with fines, fees, jail or other demeaning harsh punishments in a Democratic society. If you think sitting in a meeting discussing the fate of a fellow human being is worth ‘peanuts’ and not important enough for your time that can never be given back, you’ve been indoctrinated into the Lemming Corps! If you are a Vet that has deployed, that in its self is your ‘Out of Jury Duty’ is for FOREVER! Last minute thought, would Politicians work for peanuts pay?

  • I view all judges, district attorneys and everyone else involved with the system as worse criminals than 99% of all the people convicted and have been or are currently sitting in jail cells. And i am not afraid to tell them that right to their faces. I am pretty sure they don’t want me to allow a murderer or bank robber to walk free, because i would if put in that position.

  • Lol my parents are longtime permanent residents and don’t want to become citizens because of jury duty. I just got my second summons in the past few years. We’ll see what happens. It just surprises me to hear so many people have never been summoned when I’ve only been a citizen for 8 years and been summoned twice now

  • I get that jury duty is not a bad thing but what i don’t appreciate and like is being forced when i got my letter i was fuming mad i was already having a horrible week and now i have to be forced into something the problem is that they aren’t giving people the choice to choose whether or not they wanna go i also don’t like the threats in the letter

  • Yesterday, on January 20, 2023 I completed my jury service. This was my first jury trial I’ve been in. I got a summons in the mail back I believe on October 14, 2022 or somewhere around there and at the time I was 19. I remember filling out the 12 questions then signing up for registration. After, I went to my jury duty portal for orientation. Next, was calling or going on the portal to see when I had to go to the courthouse and I would have to go on October 27. On October 27, 2022 I went to my local courthouse to the Jury Assembly Room. I felt out of place since I knew I was the youngest one there. I was there for like about 1 hour. All that was just discussed was the 12 questions, roll call to check if everyone was present, and asking everyone yes or no if they can serve. If you said yes then you got a yellow paper on what date to return and which department. If you said no then you will still need to come back and have a good reason for the judge on why you can’t serve. I returned back on November 14, two days after I just turned 20. We’re at the assigned department and we were allowed to sit anywhere. What was discussed was the general subject about the case ( civil case if you were wondering) and we all got questionnaires about the idea of the case. The attorneys on both the plaintiffs and defense will look at them to select the 12 main jurors. Two days later on November 16, we went back to continue the selection process. Once the 12 jurors are selected and sworn in you’re basically there until the end.

  • I have jury duty coming up, I dread it. I am claustrophobic and have ptsd. IDK if that will get me out of it. I live 25 miles away, for me to be on time is difficult. I work late nights and sleep till about 930 am usually. IDK how I will manage this! I am gonna call tomorrow and see if they will let me off the hook!

  • I have a question I went there today and they asked me 2 question if I have an appointment with any doctors and if there is a reason I can’t go but all I said was I am starting school so they postponed it until December but my question is will I still have to pay a fine also can anyone please tell me the diffrence between an official jury summons the first time they send it and the second time because all mine said was official jury summons in black and red but nothing extra on the bottom please let me know

  • If you’re a nomad with no address, can you be summoned? What if they send the mail to your last known address but you don’t live there? I work remotely and recently bought an RV and Starlink internet for RVs which gives me high speed internet anywhere in the world. I’m a digital nomad, which is becoming a big movement. It will be interesting to see what they do with us. Also, how will I vote? I live in a different state every few weeks. Also it’s unclear what state I will pay taxes in. How does this even work? I’m home-fluid.

  • I have Jury Duty on July 1st at LA. But I am debating on going because I have not received a summons in the mail but when I checked online it says I have to report and call. And the problem is I can’t push it back more further since its been a year already. I am not sure what to do and I can’t miss work because it will just delay more notes that I do at work. Medical Scribe btw. Ugh 😑 I hate this!! 🙄🙄🙄🙄

  • i went to my local sitye, and clicked the request an exemption, they had me fill out a quesionaire and one question said if your disabled and do not want to serve fill out why so i idid. i have agorophobia and have had trouble leaving my home and being in crowds for over 12 years, i havent even gone anywhere by myself in 12 years, im not going to start because of juryt duty. i also dont drive and have a knee problem that can leave me bed ridden at times, of course there was not enough space to put all that so i had to put what i could. i already have my mind made up if i dont get approved im still not going, so if i were to get a fine would i have to go to court for that? or would they just mail me something? i know someone who just threw it away and nothing ever came of it. im in nh so it says fine 100-1000 and not ore than 3 days in jail but i highly doubt they will send me to jail

  • Dont want to do jury duty? When you receive your summons and have to fill out your info, you will get an option to explain why or why not you should be on a jury. Write: I would not be a fair and unbiased juror, regardless of evidence presented I would vote not guilty, unless the defendant was a member of law enforcement or gov, then my vote would be guilty. My personal bias would be unfair for both prosecution and defense, for this reason I should not be a juror. You will not only not be required to be on the jury, you would be removed from all other jury summons. Beat the system 101

  • If you are ordered to report claim financial hardship. I dont care if it would actually be an issue for you, or not. Ask them for the financial hardship form, and fill it out with any bullshit that suggests you are in a dire financial situation, and wont be getting compensated by your employer. They are very busy on selection days, and will not research this information. I did this today, and was out of there within 20 minutes.

  • Help someone, I was summoned to jury duty last night and i checked on the website last night if i needed to even come, and it said I did not need to be there for the time being, and i forgot to check before i left for work, and i come back from my grave yard shift and check the website, and it showed that my GROUP has reported that day, I didnt show up thinking it was cancelled. On accident, my carelessness forgot to recheck before i left to work.. what do i do now?

  • Laws are different for fagafornia compared to Texas if you are called even for day one you get paid. The first time I was called and queried by the attorneys I stated I believed in corporal punishment. Also said every jail cell should have a rope hanging in the cell. And I would provide the first 50 feet of rope. I was dismissed. If you are over the age of 70 in Texas you are exempt. You are also exempt in Texas if you are military or work for the board of elections. In Texas you can not postpone jury duty like you say can in California. There are many reasons as to why you can be excused.

  • They don’t pay day one that’s breaking labor laws. Secondly I get paid more than jury duty. $15 an hour. Not worth the gas money to go. $5 a day. Even if it’s $15 a day, I still make more at my job than jury duty so nope. Pay me the amount the judge is paid then we’ll talk. Otherwise I’m not taking time off of work just to get paid peanuts.

  • They can’t force you to jury duty if you have Tourette’s syndrome, considering I have that ever since 13 yrs old and I cannot stay quiet or sit still . It puts a lot of stress and anxiety on me when I have to sit with a lot of people and stay quiet . They wouldn’t be happy about it if I make a lot of sounds

  • I hate the federal type (I seem to get federal and county every year or so), especially when Philly has a corrupt DA, corrupt mayor, corrupt chief of police, etc… they consider every cop guilty, every person of color innocent. One time the questionnaire asked “If a police officer is testifying, would you automatically trust he is telling the truth?” I answered yes…. and never heard back from them for a few years. I was just being honest, but it dawned on me that was not the answer they wanted to hear. I don’t even live there. The last time I went, some were summoned from hours away.. needing to leave their houses at 4am to get there by 8:30.

  • I got summoned for the first time a few days ago for a February 22nd cattle call . I will say the following when asked to talk 1. I am an Italian born and raised in Italy, a self- declared FASCIST coming from a family of well known, prominent Fascists members of the Italian parliament and government under Mussolini’s tenure . I am extremely proud of my family and legacy and I consider this way more important to me than any government obligation .2. I consider the judicial system in America being totally rigged and corrupt and controlled by liberal extremists, where if you have no money to hire a good lawyer and you happen to be a stern conservative like me you can say goodbye to Justice 3. I consider the American trial system with a jury of people picked randomly with absolutely no knowledge of the legal system a total joke, non existing in any other country . These are the things I am going to say to the judge when he will question me .
