The child and dependent care tax credit is a tax break for working people with qualifying dependents, helping to offset costs. Eligible taxpayers can claim the credit if they paid expenses for the care of a qualifying individual to enable them (and their spouse) to work or look. To claim the Daycare Credit, the child must be under 13 for at least part of the tax year, or the parent must have a disabled spouse or dependent of any age who cannot.
A temporary change in the American Rescue Plan allows parents or guardians to claim a maximum credit of $4,000 (50 of $8,000 in expenses) for one child, and $8,000 for two or more children. The credit allows taxpayers to reduce their tax by a portion of their child and dependent care expenses.
Eligibility depends on the amount paid to care for a qualifying child, spouse, or other dependent. If you are filing married filing separately, you will not get the credit. To claim the credit, enter all of your income and the Tax ID or Social Security number of your childcare provider and enter the amount you paid for the childcare.
You can use a tax-free dependent care FSA to pay for care expenses even when married filing separately. However, the maximum deferral is $2500. If either parent disagrees, the IRS gets involved and decides who gets to claim the child. The law states that only one parent can get the credit for a shared dependent. The parent who claimed the child on their 2020 tax return will be the one eligible.
Requirements for claiming the Child Care Tax Credit/Dependent Care Credit include being married filing jointly and meeting certain requirements. Eligible Pennsylvanians can claim the Child and Dependent Care Enhancement Tax Credit when they file their Pennsylvania Personal Income Tax Return (PA-40).
