Can child support be waived in Texas?

Parents often ask if they can agree to no child support in Texas, meaning no one is required to pay. This is possible but requires a judge’s approval. In some cases, parents agree that child support isn’t necessary due to a good relationship, high incomes, and equitable sharing of parenting time and resources. This arrangement can be a solution for those who feel child support isn’t necessary and don’t want it to be part of their divorce or child agreement.

What is the new law on child support in Texas?

The Texas Senate Bill 870, effective September 1, 2023, allows judges to order parents behind on child support payments to actively seek employment or enroll in community employment programs. This change addresses the issue of parents intentionally staying unemployed or taking low-wage jobs to reduce child support payments. The new law addresses various aspects of child support enforcement and modification, ensuring that parents are not forced to stay unemployed or take low-wage jobs to reduce their child support payments. This change will help address the issue of unemployment and underemployment in child support enforcement.

How far behind on child support before jail in Texas?

In Texas, child support can be a criminal felony and up to two years in prison if not paid within two years or if the amount owed is $10, 000 or more. Enforcement must begin at the state or local level before proceeding to a federal court. Non-custodial parents can be found in contempt of court and placed in jail for up to six months for not following a court order to pay child support. Texas child support laws do not support evaders, and those who refuse or fail to pay can face jail time and thousands of dollars in fines.

What happens if a father doesn’t pay child support in Texas?

Texas law prohibits parents from failing to pay child support, which can lead to jail time. Noncompliance with court orders can result in a contempt of court judgment penalty, which can range from 6 months to 2 years in jail. Criminal nonsupport is a state felony offense that can result in a 6 months to 2 years sentence. The statute states that an individual commits an offense if they intentionally or knowingly fail to provide support for their child under 18 or for their child subject to a court order requiring support.

Additionally, the state can create an income withholding order (IWO) to automatically withhold child support payments from the noncustodial parent’s paycheck, preventing them from avoiding their child support payments.

What does child support not cover in Texas?

Child support in Texas does not cover medical or dental support, but it typically covers the child’s health insurance. If the custodial parent provides health insurance, the non-custodial parent may be ordered to pay the other parent for the cost of health insurance coverage.

Specific provisions can be put in the final divorce decree or child custody order to cover extra expenses such as child care, extracurricular activities, private school, sports programs, and college. These orders can be customized to fit the family’s needs.

If you disagree with how your ex spends child support, it is best not to stop paying, as this violates the court’s order and can worsen the situation. If you have proof that the money is being spent on something other than the child, such as drugs or gambling, you should contact an experienced family lawyer to help you get a court order to modify the child support or custody agreement to protect your child if there is truly neglect.

What happens if my ex doesn’t pay child support in Texas?

Unpaid child support can result in automatic deductions from a parent’s paycheck or other income sources, leading to fines and asset liens. In Texas, a court may issue a six-month jail sentence for contempt of court due to unpaid child support. The other parent may also be ordered to pay attorney and legal fees. Unpaid child support does not disappear, as it accumulates and is subject to interest. Despite seeking a modification and reducing payment, the ex-spouse will not reduce the amount owed.

There is no statute of limitations on unpaid child support, so it will never disappear. The Child Support Division can organize payments to minimize interaction between parents. If uncontrollable circumstances arise, the ex-spouse may seek a child support modification with the court.

How to stop child support garnishment in Texas?

Child support does not automatically terminate when a child turns 18, graduates from high school, or qualifies for an early exception. To terminate, a Motion to Terminate Withholding for Child Support must be filed in the court that issued the original family court orders. A hearing will be scheduled, and if everything is in order, an order terminating child support will be signed. If the child owes back child support, the court may order the arrears to be paid before considering terminating child support.

A hearing will be scheduled, and the judge will review the evidence before making a decision. In Texas, a court may reduce child support for the period of time the parents live together, with the parent who owes child support paying for expenses and household bills.

  • Notice that when he said he was paying most of her bills and was sleeping in his office at work, that neither the judge or child support clerk gave a crap? They only focused on his gross income, but could care less if the ex-wife was working full time or not. If I was him, I’d stopped paying any of her bills and only pay for the child support, otherwise, he is just paying for the other guy’s kids too.

  • Wow!!! perusal this made my heart sink into my stomach, this man did all the right things went above and beyond to take care of his family and his ex-wife. The state through child support puts him in a position to where he is financially going to be ruined because he cannot afford what you’re asking of him. He wasn’t given credit for all of the things he paid for prior to. Mom didn’t show up for the hearing, and isn’t making a whole Lotta money. Dad is doing what Dads should do, and the state is now going to punish him for being a good dad. This child support payment and assessment is gonna hurt him . Even though he did all the right things. I don’t know about all of you but I’m feeling really sorry for Dad I think laws need to be changed. You’re gonna ruin a good person and father financially because the numbers and the calculations of child support say so. And everything he did prior to this hearing isn’t calculated into the fact that this man pay the mortgage paid to car insurances, paid utilities, cell phone payments, Car payments and all that that implies. Now the state is gonna tell him you were such a good daddy let us fuck you over and make your support payments above and beyond what you can afford we are going to screw you the best way we know how even though you were a good daddy

  • I know his pain. I paid $443 a month for one child for 12 years based off $9 and some change per hour. I lost everything I had, including my house that I was buying, while my ex lived with her mother and refused to work. I also bought school clothes and school supplies. I made sure my daughter always had a good Christmas and birthday. I was responsible for 90% of unpaid medical bills and carried insurance on my daughter. I had to fight for every single minute I got to see my daughter, because her mother refused to try to be civil and get along. I worked every hour of overtime that I could get while her mom sat on her ass and made my life hell . My daughter suffered because of her mom’s attitude towards me. After 12 years, I got full custody of my daughter, after her mom moved a guy in who had been convicted of 2 counts of sexual battery against a two 16 year old girls. After having custody for a few months, I took her mom to court for child support and was awarded $88 a month, which her mom opposed and tried to fight. Some months I recieved nothing, one month I recieved $13, another month $11. She wasn’t paying, so I went to the courthouse to file papers on her mom for non payment. The female clerk asked if she could help me and I said that I was there about my child support. The clerk then preceded to chastise me and tell me that I needed to pay my child support. It took everything I had to turn around and walk out without dragging her across the counter and smacking some courtesy into her .

  • He got screwed over! The court system is broken, biased and unfair towards fathers. I won custody of my daughter after 5 years of court. Now she is 22 and has a huge savings as well as going to college for business and sadly her mother is barely housed. Hang in there men, don’t stop fighting for your children’s sake!

  • I did 396 every 2 weeks. My final payment, closing of my case was a celebration I can’t put into words. Absolute horror trying to see my daughter through those years and denial (threats) to be at special moments in her life. She was told by her I was a dead beat dad and didn’t pay support among years of other lies. My daughter was shocked to see all the paperwork and court acknowledgment that I paid all support. Still no relationship with her to this day. She just couldn’t bring herself to believe her mom did all that to her over those years. She’s a mess. Wish her the best and happiness. Hell isn’t hot enough for her mom when her judgement day comes.

  • I paid several bills before my ex left me. She pushed & bullied me into selling our dream house. I was granted custody of our youngest & our older daughter lives with her mom. My ex lives with her mom & dads house with her bf. I live all alone with my one daughter & she is trying to get me for child support. The system is so messed up…

  • This is disgusting. He pays half her bills, gave her a car, gave her the place, but he gets no credit for it. Take not fellas, don’t go above and beyond. The court doesn’t care about you, your kids, or even her. They care about their share of the child support you pay. They’ll be happy to watch you work yourself to death or end up on the streets or even remove yourself from living.

  • Awesome work, Team Uncoverlinks ! It’s so satisfying to see you putting in the effort to stop those shady characters. Protecting the public, especially the women, from those despicable con artists is crucial. You truly deserve recognition and appreciation for keeping us secure. I’m thrilled for you because you’re my hero. Your accomplishments definitely make you a strong contender for the Nobel Peace Prize. Keep up the outstanding performance the text access really helped to win my child’s custody!!!!!!!!!!

  • As someone who just last month finally paid my last CS payment, this article is the story of my life. They raise the amount based on some chart factoring in before taxes, before healthcare, before everything. Literally the chart shows his $20 an hour on the side, her $13 and hour on the top, and where the numbers intersect is the CS payment amount. Then they factor in who has main custody and the other details as we just saw. Notice how even doubling his parenting time with the kids only dropped his CS payment by a tiny fraction? Yeah, that’s exactly how it works. Now, if he goes out and gets a better paying job or a second job guess what happens. He gets to pay even more because he changed where he falls on the chart. There is zero benefit for him to be a more active parent because there is hardly any savings. The system is designed to force him to make more money and be less active in his kids lives. I’ve lived through this. The only way to get any balance is to not have a car payment, meaning buy a beater car and learn how to fix it yourself with only liability insurance. Live in the cheapest place you can find which having a beater car will aid in living someplace not so safe. Have the slowest internet you can. No home phone, get a prepaid cell phone, no cable TV, and eat as cheaply as you can at home. Zero entertainment for yourself. For two kids I paid $731 a month which then got raised to $971 a month when it came time to review. It was raised even though my pay stayed the same and hers went up $5 more an hour.

  • This happened to me shortly after I moved from the east coast to the west coast. My ex wife was trying to collect from 3 different counties that she moved from in less than 4 months, my support went from 325 a month to over 1300 a month and none of the courts could care less. I ended becoming homeless for over 2 years and and unable to pay at all. Then got thrown in Jail for 6 months due to lack of support. If it was not for a family member helping me to get things back together I have no idea where I would be. I had been forced to move back to the east coast and eventually I got custody and went to the family court where the judge looked at everything and then did an audit, my ex ended up getting locked up for child support fraud.

  • Once a child is school aged, the custodial parent should either be obligated to get a full time job, or they should stop receiving any support. The court should take all payments and appoint someone to buy the child’s clothing, activity fees, etc. Children should teceive medicaid and food stamps, but able bodied “stay at home” parents should not, once the child is in school full time. Home schooling should only be allowed by qualified people, with more than high school educations. We’ve got to stop allowing ignorant, uneducated buffoons to stay at home and sit on their butts collecting benefits and child support as a profession.

  • I left my husband almost 4 years ago and they wanted him to pay over $1,000/month for 1 child. I don’t need that much $!! I refuse to go thru the DA because they are going to nail him. Unfortunately he doesn’t help financially at all but he does see our son a lot now. I basically told him either see him more or pay support because it’s not fair. I’d much rather my son have a good dad than a paycheck. And I do carry all of the financial burden but it’s that or nail him. He’s the father of our child and his mental health will absolutely affect our sons so why would I nail him for a ridiculous amount of $?

  • Fathers always get shafted by the government. My buddy has his son from Sunday night until Friday night, pays for his daycare, insurance, schooling as he has special needs, all his clothing and other needs. The mother pays for nothing, has him for 2 nights a week, and he is forced to pay $275 a week CS. He spent over 20k the last few years in court fighting for full custody. She is not allowed to be unsupervised with her son due to neglect and ongoing drug issues. The school department has filed DCF claims against her 4 times for the son showing up to school smelling of weed and being lethargic (reason he has his son 5 days a week). Yet the court still suggests the mother should have placement. The court system is a complete joke when it comes to father rights.

  • Men: never touch a single mom with four kids. You will end up in this situation. When a woman has more kids than she can financially afford, she is definitely a professional child support/welfare collector and she only sees you as a provider while you’re together or an increase in the child support/welfare she can collect once you break up.

  • After spending years to get my ex through college, she left me and our three kids when I came home from work with an injury that would put me down for 6 months or more. She still won the court battle and the child support battle too. The best day was the last deduction from my paycheck for child support, that really never did what it was designed to do.

  • This makes me so upset! This man did all the right things and is still being penalized for it. I can see how this would discourage someone from wanting to get a better job. He makes more money now, but it pretty much figures out to the same since his child support went up too. Why can’t mom do the same and work more hours to be able to provide more for herself and, more importantly, her children. I worked for the child support office in my state for about 6 years and have seen some of the most ridiculous things. There was a lady who would call my line every 2 weeks like like clockwork to see when she would be receiving her CS and to make sure it was pending deposit. One month the holiday delayed her payment and she said “I can’t wait the extra days for my payment because that’s how my boyfriend and I pay our rent” I said “ma’am, child support is not a guarantee and you should not rely on it to provide for your needs” needless to say she cussed me out and was pissed off. 🤷‍♀️ She was receiving about 2,400 every two weeks for 1 child! I found out that this is a reason some women have multiple baby daddies. It’s easier to get more money from each dad for 1 child than it is to try to collect money from 1 father for 5 children. Some of these people were making more money a month from child support than I did working 2 full-time jobs. Based solely on the fact that they had multiple fathers for their children. The system is flawed for sure!

  • From the judges tone/demeanor you can tell he doesn’t care about this guys situation AT ALL. Doesn’t care about fairness or justice, just how to award more money “to the kids”. He even states she is on medicade and financial support from the State/Government…so why not the obvious questions: “You are an ‘in home healthcare worker’? How are you getting 18-hr/week of work and at ONLY $13/hr?”

  • What we learned here: don’t pay any bills of the other parent; (this was the first thing my mother said when I divorced: give nothing unofficially, everything has to have a receipt). And why the hell did you give title for free? She immediately asked for a review after it. And you have to check her salary, it is part of parenting here. She could hoard hours and make double compared to the basic salary some months.

  • There was a guy who got 50/50 custody by working nights and sleeping while kids were at school but would be with them during the days when they weren’t in school. He found it easy to get a babysitter who was happy to get paid cheap to mostly just sleep in the same house as the kids and only occasionally get up in the night with them. He eventually got primary custody when mom had to work more as his obligated alimony payments stopped after 18 months and she couldn’t afford her lifestyle without it and the courts refused to extend alimony or reduce his custody so she could get child support. The main way to not have to pay child support or at least not as much, is to be with your child(ren) as much as possible. If you already spend lots of time with your kid then the courts rule it’s in the best interest of the child to keep spending that time with the father and will generally grant custody to maintain the amount of time the parents spend with the child. The real problem is when the mother makes it impossible for the guy to be with his kid leading up to their day in court and the courts are like: “🤷‍♀️ it’s in the best interest of the child to maintain their current relationships”🤦‍♀️

  • Imagine doubling the time you have your kids and mom moves to a 40 hour work week and your child support only goes down $100. Something’s jacked with their calculator. And why tf this woman have 4 kids when she can’t afford to feed them without government assistance?! Birth control!!! You have no business bringing children into the world if you can’t feed them. The government needs to start giving out free birth control, tubal ligations and vasectomies.

  • This is a good example of why you get a lawyer. This guy droned on. No wonder the judge and the lady didn’t get it. They got confused because Carl wasn’t fully clear. A good lawyer would have cut through the bs and Carl would have had a better outcome. Don’t try to represent yourself. You may get shafted.

  • Wow… As a mom this is weird. I didn’t let them increase my cs without talking to the paying parent. I don’t ever recall them asking me how many days the other parent had. Granted we had visitation on record but it depended on what was going on. Sometimes more or less. I always preferred the other parent be in their lives.

  • I currently pay 1395+ medical insurance and 50% of medical bills for one kiddo. Never been an issue. However she graduated early and will be 18 in February, and all the sudden I get paperwork saying they want to raise my cs to 2680 a month, and extend it through college years. NeverMind the fact she has a full ride scholarship and I bought her a brand new car as a reward for her hard work. AND I’ve ALWAYS paid for her school tuition and extra curricular as well as all school supplies and clothes. Now I have to look like the a$$hole and fight it. 7 months before it all supposed to end.

  • Brought tears to my eyes!!! Thank YOU!!! I was a victim of these assholes but now I’m a survivor enjoying you helping other victims and really screwing with the heartless ass!! Thank you for all that you do. Uncoverlinks online WHY doesn’t our government/police get involved like you do????? I reported it but ” nothing they could do!!” Much respect as i get my child in my care with the evidence i needed. Thanks…..!!

  • You guys are heroes Uncoverlinks. Making the world a better place, for real!!! I love the evidence after the access to win my child’s custody. Does the FBI have a department doing something like this as well? If not, have they asked you guys to train people and teach them? Even if this idea is out of your hands I’m convinced they should acknowledge this issue and take action. I get so pissed off when I think of people are being cheated by those they love with all heads…!!!!

  • Domestic relation will alway side with who ever has custody, $912 is a good bite to the budget for 2 children. I paid $800 for 1 daughter and I did all the extra spending like you did. Stay the course and stay in you boys lives and they will always remember you are there Dad! This will be huge in the future!

  • This poor guy. I never had my ex husband’s income reviewed. It was automatically reviewed 15 years later when our first daughter turned 18. That took a whole year to process. Until it was final we agreed that I would give half the support to our 18 yr old daughter. Then when they final approved it his support was more for one kid than it was for two because his income had doubled. I felt bad but man it was a huge help. He wasn’t upset at me but just shocked. Cheers to the parents who get along.

  • Look at the law. Whatever the maximum is, is her target. Her awards: Last time I checked, 65% of your net disposable income. This is enforced by laws, a federally funded legal agency and criminal prosecution. Your awards in court, visitation, …. visitation, is not enforceable without taking her back to court, lawyer in tow, and there is no “Child Visitation Enforcement Agency.” View women for what they are before you commit your lifes blood to her future. Your future is optional.

  • I can say that I feel for this man. Myself was in the exact same situation. I was paying $400 per month for 2 kids, I got every other and split holidays. The review came up and they used my pay stub which happened to be my highest of the year. My pay was 50% hourly and 50% based off sales so not guaranteed. Mom had a nursing degree but was electively not working as she was remarried. The difference in income, mine being calculated way higher the reality and she not choosing to work, increased my payment too $1125 per month. I was clearing $80 per week for myself to pay my bills. Fast forward 2 years as it too this long going through an attorney, had to resubmit the paperwork showing my actual income and calculating her income based off median income made for those of her degree got it reduced back down to $600 some. The whole calculation the state uses for this is really unfair and in my opinion shouldn’t have an automatic review. If the parents made an agreement and all things remain koshier between them, the State should mind their own business. Rant!!! I apologize. It’s such a sore subject to me.

  • This Man is Responsible and a Caring Parent with a Level Head and thinks Constructively and Honestly. So, Judge What’s More Important a Father that Works a lot to Ensure His Children are taken care of even when he has taken a cut in pay or How much time he spends with the Children being the NON CUSTODIAL PARENT? I saw my Father *1 Day a week as he worker on average *16 Hours a Day to take care of me and my younger Brother. Something Screwed up about this courts so-called FORMULAS.

  • Help me understand. Some people think that child support for two children at 400 a month is enough? Feeding, clothing, laundry detergent, soap, gas in the car to get them to and from school. Extra school activities i.e. football and band are expensive. Eating out, movies, vacations to round out a good life for your kids. Most mothers have the kids 90 percent of the time. And the more people the home the higher the utilities are a month.

  • I’ve known so many guys that get screwed with child support. One co-worker of mine had to live on someone’s couch because he couldn’t afford his own place after paying for child support. Child support has gotten so out of control, with no end in sight. This is what makes some of these psycho men go crazy and take it out on their family.

  • Why are they pushing every other weekend when he’s saying he takes his 2 every weekend for Saturday to Sunday, that’s the same as Friday to Sunday every other weekend. And it doesn’t sound like he’s making more now the way he is talking. Kudos to dad that he’s trying to spend more time with his kids as is.

  • Thats the thing is that it often leaves good fathers with not enough money so they can live!! The ex spouse should have objected to the increase!!!! How does 20 dollars an hour equated to 900 and something a month???? How did he afford to pay off all of that with 15 an hour and pay his bills too. He’s living with girl friend so rent split in half. But the mother needs to get a BETTER JOB !!!! 13.OO AND HOUR !! won’t take care of kids.

  • This is why men are not getting married. The deck is stacked against us. One quick question, how much child support is her ex paying for the other kids? If he’s paying $900+ for 2 how much is she getting for the other 3? I understood from this that she’s getting assistance to boot. If you want to know why she’s only working a specific amount it is to keep her assistance up and running. She’ll never work extra so she can keep it. There needs to be a way to make sure that the money is spent for the kids only.

  • In the 80s my brother’s wife did him dirty by filing a false restraining order against him claiming he assaulted her. He was a trucker gone for a month when she claimed the assault happened. He came home and his key no longer worked to get into the apartment. The police showed up and my brother was confused as to why they were there. The police told him he could not be there. My brother told them this is my home and they said not anymore. The wife moved her boyfriend into the apartment and changed the locks. Then they came after him for child support for his son. He was making 4 thousand a month at that time. They left him with 300 dollars a month to live on. My brother had to sleep in the back of his truck and his boss felt bad for him he gave him a food card to get meals at the truck stops. My brother never saw his son again.

  • This is sickening.. Man forced to pay beyond what it cost to take care of 2 children each month, while the mother works less and collect government assistance. Now he has to get another job to make ends meet and that will take time away from spending it with his kids. And then when the case gets reviewed, they will increase his child support because they will add the two job’s income. Its a lose lose situation

  • Well she would only need to work 18hrs since he is still paying quite a few of her bills. If he stopped paying she would have to work more hrs. She also can work more since the boys are now in school. My sister did that because most states make it easier to get welfare and food stamps then making them get jobs. If they want to be on welfare and food stamps make them either work for the state( clean up parks, paint buildings, pick up trash) or volunteer to cover the costs.

  • Women like his ex are the reason I stay single. Watched my brother go through this same crap for pretty much 12 years. And the screwed up part was that his wife cheated on him and he caught her. But yet, the state still took his kids from him and gave them to her. And this is a woman who slapped her daughter across the face in front of friends and family for asking for a potato chip, after which, she gave the chip to the dog. This woman let my niece suffer eight hours with a broken arm until my brother got home from work. My brother had no idea anything happened until he walked in the door. This woman spent that eight hours sleeping and telling my niece to quit being a baby and to suck it up, that it was just a bruise. YET, she still got no punishment, ruined the relationship between my brother and his kids. The courts in this country are backwards and it’s disgusting. Oh, and the final thing. She didn’t use ONE bit of child support for the kids either. She spent it on stuff for herself. Fancy stuff, a new jeep, starting a home business, and other things. All while my brother worked 40+ hours every week with rarely a day off, living in a small, crap $350 a month apartment.

  • I started with $ 150.00 a week when my daughter was 6, school tuition and health insurance back in 1993…1 child… alternate years tax claims: quite generous for the time…we were flexible about weekends and vacations, I had primary custody. I never once asked for a single penny increase. Never asked for extra for school activities, special lessons etc…to this day my daughter expresses that she was glad she was never aware of money issues is glad to know I was not every guilty of trying to gouge her father. My wages and his went up over the years but the arrangement never changed.

  • Knew a guy that had 1 kid, wife wanted home extensions that cost $200k so guy was doing extra o/time to manage it. When the home was finished she asked for a divorce, took the house & hooked up with electrician that did reno work but he still had to pay child support while moving out and renting yet she didn’t work. System is so screwed up.

  • I had child support double with no notice, I had taken a job that paid considerably less, because I could not take the two to four hour commute each way. I had gotten married and I was the sole provider for my wife, her daughter and our new daughter. They sent no paperwork, just doubled it with no notice. Had to go to court, she did not bring any paperwork, her financial info twice to court, the judge made it stand till she brought in her paperwork. Then they lowered it by sevety five dollars, I had 49% custody and paid all insurances and ALL extra curriculum expenses. He is getting off lucky, i was paying that for one and she had a good job

  • Thanks for showing this, this helped men to realize the high risk having kids or marriage. A government paper doesn’t make your wife never leave for any reason. I never heard anything about the women. If she’s applying for Medicare and food stamps while father is still in kid’s life, what makes her qualify of being a parent? The reason why courts are 99% for women is because 75% prisoners come from single mother households. No prisoners means no money for the courts. I thinks that’s why court system are bias against fathers. Women are emotional and can change their minds at anytime even if you talk and agree on something in the past, they always back track as part of their survival instincts.

  • I had the same nightmare, I had 2 children, with a woman who already had 4, with 3 different fathers. When all was said and done, almost 7 years after divorce started, I received custody of my 2 sons. All told, between lawyers, alimony and maintenance, I am out close to a half a million dollars. Now, and from what I have heard through the grapevines, she is pregnant again at the age of 40 and 3 of her 4 kids that I helped raise for 7 years starting at the age of 2 and above, are in jail and facing serious time for their crimes. My ex-wife, like this guys ex-wife, belongs to the streets.

  • You cannot get “credit” for paying her bills, phone, mortgage, insurance, etc. Child support is about parenting time percentages, and income. Even if she married a very rich person, that dad here would still be paying that same amount unless parenting time and income of the actual parents changed. But, he could have simply NOT paid all that stuff. Crazy that if he doubled his parent time it only dropped eighty bucks. Also, he could have asked for her to be ordered to work full time, or that the court use a full-time calculation. The whole process is agonizing, and very often abused. That said, he seems like he’s trying. He could have requested a “seek work” order, and a “full-time” calculation. Usually, they will force the dad to “seek employment” but almost never moms. Also, they’ll calculate “earning ability” on dads, but almost never moms. Thus, females can live off of child support, but dads cannot get out of child support. Moms can allege “disability” and provide zero documentation but dads cannot. Parent Alienation Syndrome is common by moms against dads, because courts automatically “believe all women” as if women are more honest, or better parents.

  • The way they just casually mention the fact that the mother works 18 hours a week and only makes $13/hour and, “Oh I guess we could try to find out why she doesn’t work more hours” when this dude’s child support is being DOUBLED — Guys. We need to get focused and get organized. We gotta start being a TEAM. There need to be articles and articles online clearly delineating how all this works and explaining everything from tip to toe, with special attention to educating boys on the cusp of pubescence about the risks they take and the rights they sign off whenever they put it into a girl. We have no rights in the court system and a lot of dudes just walk right into the meat grinder that it all is for men. People don’t even know what’s going on. I mean, some do, but not many clearly understand.

  • This is exactly why child support should not be “mandatorily” relegated to the system…. the “system” doesn’t have any leeway for specific situations, even when both parents have in agreement a satisfactory support amount ahead of time. It’s criminal for the “system” to be the “authority” in these situations 😒 Take note: that’s not the same as a situation where both parents are not in agreement. That should be the ONLY time the system assumes authority 😒

  • LESSON FOR ALL MEN: DO NOT DO More than what you are suppose to do or help out more than you should by taking more time or being generous with money with a woman who is not compatible with you or who is no longer with you Period. Women are conniving and vindictive by nature. She probably reported that you had alot of money because ‘you helped her out more’. Meanwhile she’s out there dating. The whole time you’re giving to make her life easy, the whole time she’s plotting to make your life hard. Don’t be fooled by psychological influence of having little kids. Don’t do too much. Once you’re separated – Move on with your life and be STRICTLY OBJECTIVE. Do not change schedules or add visitations. Help the kids when they are teenagers/older and understand. Young kids don’t understand the help you’re doing. Give them extra financial help when they are older and understand your effort and learning how to get a job. Follow strict rules of being separated. Be very OBJECTIVE. What matters is how those kids understand when ‘they grow up’. Don’t drain your pockets now, time, and mental health, then at their teen years when they really need help to get off their feet, you don’t have a dollar in your name to help them. They’ll think you’re the one who doesn’t work hard. Once you are Separated you ARE Separated. Don’t put your self through a circus by doing more. You are no longer a team so be objective. Help the kids with extra when they’re old enough to understand the extra that you are doing.

  • 6.) “I guess your child support went up because you make $300 dollars more per week than you made the last time the order was run” that’s only $800 per week which is only $3,200 per month PRIOR to taxes, insurance benefits etc being taken out, so the court now declares half of the new income earned goes to the children which is fine only if the same is happening with the custodial parent aka the mother. Think about it, if she is getting an increase in money from him AND he is taking care of his obligations associated with medical etc that would mean she should no longer qualify or even need the additional state assistance right? Why is she not being forced to go out and find/do more work to bring in income so that she is no longer in need of public assistance? Why are the additional 4 children’s fathers not being tallied the same? And if they are, this circles back to the original question which is is why is she allowed to continue to live off of public assistance while also not applying herself to the work force even half as much as any of the fathers of her children? 7.) The Judge then admits “He does not know if her income status has changed or not” so how do you know about his? Why is the fathers income the ONLY income that matters if the children have 2 active parents? The Judge then also begins to do what we all know family court systems are actually designed to do which is, cause disfunction between the parents. I say this because the judge states “Well she got the same order you got in the mail, did you talk to her” as if she had the ability to put a stop to what the court decided they wanted to do, the judge clearly stated because she is in public assistance programs, it AUTOMATICALLY triggers in the system for them to go after the father for some sort of financial assistance going towards her and the children so this was done without her knowledge, this was done without her asking, but now you want him to go and work something out with someone who did not request this in the first place which will then just lead to disfunction between the two because she has the kids to be concerned with and he’s bringing drama to her attention that she is not even aware of, concerned with or wanted in the first place!

  • This is sad. Then there is the other side. My sisters ex husband made well over 100K a year as did his new wife. She did get some child support, but it was not close to what they needed. They were supposed to pay 1/2 each for special things that came up such as activities etc. He refused to pay because according to him, activities such as school sports weren’t necessary. He refused to pay 1/2 for things like contacts for my niece for her to use during basketball and volleyball because they aren’t necessary. Glasses are very hard to wear during these sports due to contact and them both being very physical. When he bought something like an ace bandage for a sprain for one of the kids, he demanded that she pay 1/2. He refused to help with college (my sister struggled, but paid for the whole thing). Of course, a parent paying for college isn’t required, but he claims credit for the college education. He took her to court at least once a year to try to get his child support lowered and lost every time. The last time, the court said he had to pay her legal expenses because they were tired of his taking her back to court for nothing. When he and his wife had a child, it was lowered. By the way, this kid was sent to private school since preschool and plays a multitude of sports that are apparently necessary. I hope this gentleman is able to get a better judgement, it just doesn’t seem fair. He has been more than fair with his ex wife and he is the kind of man that is a great example for his children.

  • You choose to have 6 kids and you choose to work 18 hours a week at minimum wage. That’s absolute BS that anyone should have to pay more because you want to be lazy and collect everything you can from the system and all of the fathers. You know she’s getting food stamps and medical and now all of the child support as well. She’s choosing to keep this lifestyle purposely…he is doing exactly what he is supposed to do and was also helping her out- even gave her the vehicle to keep…🤦‍♀️

  • What really gets to me is how this doesn’t actually work out for anyone. I didn’t get child support for my 2 kids until my youngest was 18. Then I got 100/mo back support for 2 years. I had my kids 100% of the time he made no effort to have anything to do with them. Yet this guy is making much larger support payments to the detriment of his own survival. We need something that works for everyone.

  • I got divorced when my children were 1, 3, and 5. Their mother never paid one cent in child-support for the 17 years that she should’ve been. My children should’ve had more than I could give them, but Hawai’i and Ohio allowed her to just disappear without having to provide any support at all. Courts and liberal maternalistic judges are far too lax on women and far too unforgiving on men.

  • The way they figure child support is ridiculous. When I divorced in the 90s, I was nearly 28 and had never worked outside the home. My husband left, and I retained the home and all the bills, as well as the two children. The job I managed to procure was crap, but I managed most of the bills and only required about $100/month. He refused to pay it, because he was that kind of person. The court ordered him to pay nearly 1/5 of his income (way more that the piddly amount I asked for).

  • CRAZY how the mother with a job of a teenager so she doesnt have to get less payments, on assistance or money is considered a better full time parent than the man working and earning a living. When men do well for themselves they get penalized. Its a hustle against men. If you need child support you are not the best for the children. That means youre struggling.

  • My father was honest and upfront with me. He openly told me he never wanted to be a father. He made us to make our mom happy as she did. She eventually went crazy and divorced him. He paid all the way until I was 23, despite not being required to after my mother booted me from the home at 15. I never learned how to be a member of a family, but I did learn to stand by what you think is right from him. He paid triple what I was owed. Fact is, an absent paying father is better than a happiness seeking mother. She almost had me dead. He offered to let me stay, but being a feral and completely independent child, we both knew that couldn’t last.

  • I paid child support for years my X got with another man who had 3 boys she abandoned my / our two girls to me and begged me not to make her pay child support and i told her and her man to keep there money and stick it were the sun don’t shine and my girls seen how there mother really was …… i love my girls so much they are my life …..

  • Guy did amazing keeping his cool. Mad respect for him doing that. The mom knows that by doing the bare minimum, the more help she gets. I agree with other’s in here. Stop helping with the extra in that house. Your boys are the only ones that matter in this case. It’s messed up how dads get screwed over. I gone through it myself. Utah favors the moms. Even when they are unfit

  • I raised two as custodial father from 5 and 7 til 18. She was given an order for 48 per child at the divorce trial and I was never given a penny more with all the requests as allowed for reviews. Plus her employer issued her vacation checks with only one week removed, eventually that was 6weeks with one week for child support. Every year I followed procedure to recover that to no avail. Just lost weeks. Every time I called FOC I was passed from woman to woman having to explain custody to each one as I was passed around to sometimes 5 or 6 different workers. Never had any results. To make it all the more an insult. She overpaid on the oldest by 6 weeks in their minds so they seized the youngest check for six weeks to make it up to her (?). Nevermind the 39 weeks she never paid because her work never took it from her check. Plus she was supposed to medical insure them and never did. ( I did that) Try being a man receiving child support. I raised them in good manner and dressed and schooled well. And never doubting they are loved. Both have very good lives as adults. I didn’t need her drunkin influence but was required to give standard visitation. This guy here is being railroaded by supposedly equal female culture.

  • Paying her bills not ordered by the court is a gift and can’t be included in trying to reduce child support. Stop giving her gifts. That will force her to go and get a job that can pay her own bills and reduce your child support. Noticed the judge didn’t bring up that fact in the meeting. The judge obviously wants those gifts to keep going her way, sickening.

  • Bro your lucky. My son came to live I.y home in 2014 and turned 18 in 2021. He does not attend college. Not only did I continue to have income deduction they garnished my income tax Now I have zoom court on the 19th of tjs month because I am supposedly 4000 behind. Although I been paying only arrearsges past few years. And paid 8800 two years ago. In florida the only way for me to address court is to hire private attorney. Now they cannot argue with facts. They can look up school records from the middle school in Alabama he attended in 2014 while living g I. My home. They should retro act the support amount but I am in florid so I doubt it

  • I feel for you, I was awarded custody of my daughter at 15 months, Her mom was ordered to pay $25.00 a month in child support and she had a job making $52,000 a year. When I asked why it was not higher, the judge told me “I sat it that low to force you to get a better paying job” Her mom only made one payment, I took her to court 8 times to raise the amount or just make her pay what she owed. After she owed over $5,000 the state garnished her tax return, kept 20% as a handling fee and gave me the rest. It only took 16 years. She still owes back child support I will never see. My daughter cut ties with her toxic mom and we live the happy life now.

  • Crazy how US courts calculate child suppirt! In Canada, child support starts at $500 per child per month doesnt matter how low your working income is. There are no freebees or 2 for the price of one! Custodial parent income is not included, overnight stays not included. Child support goes by income according to court chart rates, usually last years tax statement is used as proof of income. Healthcare premiums not included in calculation, some provinces have no monthly premiums, other provinces its capped and affordable. Interesting difference, A home health care worker makes $22+ an hour with full benefits. They have to be certified (trained at college level, nursing assistance) and a criminal record check clearance. Run by government agency. Courts dont care about “hardship” on non custodial parent, it is what it is! Only 498 for 2 kids, he got off easy! 2 for the price of one!

  • Man this is why it is so so important to do your best to keep the the damn state out of your family support situation. These people do not give a damn about your family it’s all BS. I had no idea they based payments off of how much Over night time you spend with your children. 😮 Dad needs to provide for the kids not to mention her other bills. Yep he has to work more meaning he’s spending less time with the kids. Mom isn’t working but 18 hrs. Makes sense she’s spending more time with the kids ( they didn’t even say how old the kids they have together are, she could have younger babies that require her to be home. That isn’t his problem!) This is wild to me, I think my ex and I now realize how being able to co parent and support each other on our own like adults should. Was Priceless literally … Our baby boy will be 20 next month. So we have been out the game for a few years thank God for that Good luck fellow Americans 🍀

  • Judge is very responsible. That AG representive only wants to stick it to him. The father just needs to know his rights and consider moving closer to the kids so he can get more parenting time and pay less. Never let the AG office calculate your rates. Know your rights….. It’s based on net after medical. Get your kids off public assistance. Carry them on your insurance.

  • If it was calculated on 53 overnights before, and it is calculated on 53 overnights now then that shouldn’t be a reason for change. Why would it cost double to support the children just because he got a raise? It’s CHILD support, not spousal support. There is a simple cost of living amount in each area of the Country. The support rates should be based on only what it costs for the children, not by pay difference. By all means, make him pay what is fair, but doubling in a year is not at all justified.

  • Never wanted kids. Didnt have kids, though many past girlfriends tried to change my mind (told them from the beginning fatherhood was never in my life plan…and ended relationships when it was apparent they wanted kids). I will never be involved with a single mom. Because of this, I chose to be alone, and i still dont regret it. Finding anyone past 50 with no kids is pretty much impossible

  • Domestics in PA told me it doesn’t matter if I had to live in a tent and ride a bike I had to pay what they say. They took over 55% of my check. Because of that I got a few checks for zero dollars and zero cents after taxes. That happened because I had over time. Than they raised my CS again. I busted my ass to pay it until finally I became to sick to work and ended up disabled. CS should never be more then 25% of someone’s pay. I was also told that college was a privilege not a right so I was told I had to work a full-time job or face jail. My child’s mother got to go and because of that my support was set at a higher rate.

  • Child support doesn’t go to the child it goes to the state as the fed matches the state up to 66% of what they collect annually which goes to pay for the salaries of those who run child support and the courts in general. It doesn’t matter how much you make it matters how much they want. Chid support is all based on contract and if a woman wishes to file they gotta pay 25.00 to do so which makes them a customer and they provide a man’s information and sends the child support agency after anyone named. It’s a racket and the woman can be sued just like the child support agency for rights violations. It’s a scam to make the government bigger at the expense of the people. Suspending peoples drivers licenses putting people in jail and making them Destitute over being poor they make it a crime to be poor it’s time to get educated and sue these bastards to oblivion.

  • Twenty dollars an hour and you have to pay $912 a mo in child support. Thats ridiculous!!! Why does his child support depend on what she’s making? So women can just not work a lot so they can get more child support. How is it his problem that she won’t work? It should be a percentage of what you make and that’s it.

  • I can’t stand this “judge”! I was before him several times after I took on my niece.. his rulings are ridiculous! He ordered the bio mom to only be responsible for payment of child support at $15 a week because she didn’t work and if she went back to work at minimum wage and had to pay daycare for her latest few kids she would only be obligated to $15 a week. I finally was so fed up I offered for him to raise my now 5 kids $15 a week to raise them all. No response! My current husband was before him many times (excused to work at courthouse prior to their marriage-divorce) and was brutalised! It took years for the truth to come out she was friends with the judge and getting very favourable treatment! It all sickens me!

  • The system is broken in that they bill the dad according to gross income, yet he gets no tax advantage and therefore pays a huge amount of tax. If the child support approaches fifty percent, and he has another twenty five to thirty percent withheld for taxes, he is supposed to live on twenty percent of his income. At $20 per hour, that leaves him $160 per week, or $640 per month. Because he makes $20 gross, he can’t get any assistance, and can’t get any relief despite being more than double below poverty level. It borders on infringement of the 13th amendment, which abolishes slavery. Mom, with six kids get food stamps, bill assistance, Medicaid, and a reduced tax rate that is probably less than 10 percent, so at 13 per hour, she clears over $450 per week on wages, plus $400 of his money plus several hundred in food stamps and assistance. The disparity is mind boggling. All support amounts should be strictly based on net income, not gross income.

  • Told my woman way before we had kids that if she ever took my child etc I would end it for her. If she wants to go then go but you mess with my child you wont do it twice. I told her if she cannot understand that then best she move along. She said she wouldnt blame me and we have been happily married many years.

  • Family Lawyer, I acted for a man who paid Child Support on the dot in the amount specified. He received a Notice from Child Support increasing his Child Support. He objected on the basis that his income had reduced on the basis that he had injured his back (verified by medical records). His objection was over ruled on the basis of his past demonstrated capacity. He sold his home, sold his car and left the country.

  • My husband paid more in child support for 2 kids than the price of our monthly mortgage. And then when the kids began working, driving etc she charged them rent… must be nice to not have to lift a finger to support yourself. Thankfully after 15 yrs of us paying for her cushy ride in life the kids are adult and she has to make her own money like the rest of us 😀

  • Yep.. they go year to year and base amount on what you made as income for the year So if you make good money for a year when you show what you made amount goes by that what you made in the last year but that dont mean you make that every year… Then the next year what ever you make it shoud go according to that. That’s how it should go Im kind of wondering about if it ever drops down once it goes to the higher amount Also keep recipes of extra that gets paided out on top of the support Not a good time during a divorce Stay strong. Nothing but the best to you and yours

  • Dude I been through this for yrs but the courts go upon gross. Plus 3 yr no change just cause in court papers does not make it legal plus courts go by the worksheets. But the judge can alter a agreement if need be I had this happen to me. If your ex has a degree etc. Then she can be held accountable for this such expectations as in income etc. But can’t make a 100% change without the update and said ex wife’s income etc either.

  • When he started reading his statement it was clear he wanted points for being a “good guy”. Unless it was court ordered, he shouldn’t have paid a dime more to her than he was forced to. Paying off the car and paying her bills? WTF? Wasted money. I would have demanded 50/50 custody and with the money I saved I could afford day care or a nanny for when I wasn’t available. But he’s not doing that. Truth is, this guy paid her off by paying her bills so she wouldn’t cause problems. Then he dumps his kids on her 86% of the year while he works and plays the rest of the time and is surprised when his payments increase on review. He should man up and take his kids 50/50 and/or be smarter and after this hearing all the extra money being given to her stops dead. Let her petition the court for more. Since she failed to appear for the hearing, I don’t think there would be any other modifications made in her favor.

  • I think BOTH parents should be responsible financially for their kids…. But this is so sad for him! I make 40k. I bring home only $1132 every 2 weeks after tax. I don’t even have insurance come out of MY check. This poor guy is giving 50% of his income. Wow! He should be given credit for all of HER bills he’s continued to pay.

  • As an American EX Pat, living in Japan, I can`t understand how government agencies do not have total visibility of every dime you make gross and net if you are an employee in a company. If that information was on hand you could easily see how much his base salary plus commission netted him annually compared to his current base salary per year annually and make an educated comment on how much he was actually making before and now. I get it if he has his own business and he self reports or something but he is literally a company employee, and that information is not available on hand? WILD

  • They don’t care about your other bills. I said the same thing. Of course my child support is more than his $925/month. Oh…and the mother of my kids got a credit for having other kids under age 18 in her house. That “credit” was actually a deduction from her income which increased the amount I was expected to pay.

  • She probably only works 18 hours a week because she get child support from the other Fathers of her other 4 kids. In Canada about a decade or so ago. There is a Woman who collected Alimony and child support from her Childrens Father and approximately 8 other guys. She was collecting between $10,000-$25,000 Per Month from these guys. The Laws are ONE Sided in many cases here. Don’t get married and have kids if you are a guy unless that woman is actually a TRUE GOD LOVING AND FEARING LADY or you will get Cheated ON, Divorced and Loose everything you own and built up. Plus you will be paying for the Next 20 years of your life on top of it.
