How Labor Laws Can Stifle Innovation?

A new working paper for the National Bureau of Economic Research reveals that regulation can dampen innovation, as companies are hesitant to invest in their operations. Generating creative ideas and turning them into innovations is key for competitive advantage. However, efforts toward creativity and innovation are often hindered by constraints such as lower digital production costs, altruistic behavior, and rewards from “immersing” in creative processes.

The traditional view of IP law is that copyrights, patents, and trademarks give creators a limited monopoly on their inventions or works, allowing them to reap the benefits. Factors that might inhibit creativity in the workplace include a conservative, low-risk attitude among top management and lack of support from employees.

Organizational policies may reflect a lack of interest in employees’ wellbeing or be designed to deliver productivity or save money without leaving anyone behind. A synthesis of literature suggests four categories of recommendations for fostering creativity and innovation that seem problematic for organizational ethics:

  1. Breaking rules and disregarding regulations is necessary to find new solutions. Dismissal laws can enhance employees’ innovative efforts and encourage firms to invest in risky but potentially groundbreaking projects.
  2. Artists’ “portfolio careers”, which are generally based on freelancing and self-employment not protected by regulations and welfare, limit the organization’s innovative output.
  3. Creative workers must find a balance between self-expression and recognition while earning a living. If the environment is negative, people will stop being creative.
  4. The observance of the right to disconnect law can encourage employees to develop their creativity while protecting those for whom calls for creativity can be problematic. In businesses, it is important to consider the potential effects on income and earning capacity of creative workers.

The ego, or one’s perception of self, can be overly active and inhibit exploration or personal growth. An inflated ego may cause individuals to become stuck in past glories or produce tired permutations of the same thing over and over again. Negative people can greatly undermine creativity by constantly telling us that we cannot do something or that we are failures. While praise is nice, it is crucial not to surround ourselves with sycophants who constantly inflate our egos.

Functional fixity refers to the cognitive inability to look past the designated function of an object or idea. This cognitive bias prevents people from seeing something beyond the initial or designated function of an item, term, or concept. The term first emerged as functional fixedness and came from Gestalt Psychology, emphasizing wholeness.

In summary, stress, chaotic environments, beliefs, fear, self-criticism, ego, negative people, and functional fixity are all factors that can hinder creativity. By being aware of these barriers and finding ways to overcome them, individuals can foster a more creative and fulfilling life.
