South Carolina Governor Henry McMaster signed into law S. 11, which added Section 8-11-150 (A) and amended Section 8-11-155 of the South Carolina Code of Laws, to provide six weeks of paid leave at 100% of the eligible state employee’s base pay or two weeks of paid leave at 100% of the eligible state employee’s base pay depending on the qualifying event. In 2022, Governor McMaster signed into law Act 149, which gave state employees up to six weeks of paid parental leave for the birth, adoption, or fostering of children. A bill to amend the South Carolina Code of Laws by adding Section 41-1-140 so as to require eligible employers to provide paid leave is expected to increase the number of paid leave hours for state employees.

State lawmakers believe this could be the year they will be able to guarantee paid time off for state employees when they welcome a child. The bill would guarantee paid parental leave for public school teachers and full-time employees in South Carolina when they welcome a child. South Carolina is only one of three southern states to guarantee paid parental leave for state employees.

The firm will offer paid maternity, paternity, and adoption leave (“Parental Leave”), in accordance with the following terms, to employees whose regular work includes maternity leave. South Carolina FMLA Maternity Leave does not dictate the length of maternity leave, except in cases where an employer has 15 or more employees.
